Terms and conditions

The owner of the e-shop tiigitaimed.ee is Tiigitehnika OÜ (registration code 12656504), located at Ojaääre farm, Ojaääre tee 3, Kuldre village, Antsla rural municipality, Võrumaa.

1. Terms and conditions of sale

1.1 The Terms and Conditions of Sale apply to the purchase of goods from the online shop tiigitaimed.ee of Tiigitehnika OÜ (hereinafter referred to as the Seller).

1.2 In addition to these Terms and Conditions of Sale, legal relations arising from the purchase of goods from the online store are governed by the Consumer Protection Act, the Law of Obligations Act of the Republic of Estonia and other relevant legislation.

1.3 The images of the products in the online shop are illustrative and may differ from the reality.

1.4 Tiigitehnika OÜ reserves the right to withdraw from the terms and conditions of sale made through the online store and to not deliver the ordered goods in case: the goods are out of stock or the price and characteristics of the goods have been displayed incorrectly due to a system error in the online store. If the Seller is unable to fulfil the order, the Seller will inform the customer and refund the amount paid by the customer within 14 days at the latest.

1.5 The Seller has the right to make changes to the terms and conditions of sale without prior notice.

1.6 There may be unintentional errors in the presentation of products on the Online Shop.

1.7 The prices of the products sold on the Online Shop are indicated with the product and are displayed in euros. The price is subject to a delivery charge.

1.8 Aquatic plants, shore plants and wetland plants shall be delivered to the Customer in 9×9 cm pots, water roses in 15×15 cm pots. NB! Please note that in spring the plants may still be in the emergence phase – there are few green leaves but the root system is strong.

2. Making an order

2.1 Select the product you want and add it to your shopping cart.

2.2 To place an order, scroll to the shopping cart and select the appropriate delivery method and enter the destination/preferred parcel machine (unless you have selected “Pick-up”).

2.3 After selecting the mode of transport, fill in the required data fields.

2.4 Once you have filled in your details, select the appropriate payment method and press “Place order”.

2.5 After the Transaction has entered into force, an order confirmation will be sent to the Customer’s email address provided by the Customer when placing the order.

2.6 If the ordered goods are out of stock or cannot be delivered for any other reason, the Customer will be notified as soon as possible and the full amount paid will be refunded immediately, but not later than 14 days after receipt of the order.

3. Delivery of goods

3.1 After the sales contract has entered into force, the Customer can receive the ordered goods by the following delivery methods chosen in the order:

3.1.1 Goods ordered by parcel post will be posted within 5 working days after order confirmation.

3.1.2 It is possible to pick up the goods at the agreed time at the following address: Ojaääre farm, Ojaääre tee 3, Kuldre village, Antsla parish, Võrumaa.

3.2 The Seller reserves the right to deliver the Goods to the Customer within 30 calendar days in exceptional cases.

3.3 If, upon receipt of the goods, it becomes apparent that the goods ordered are defective or have been damaged during transport, the Seller must be informed immediately and a photograph(s) of the damaged goods must be sent to info@tiigitaimed.ee.

3.4 The Seller shall not be liable for any delay in delivery of the Goods if the delay is due to circumstances beyond the Seller’s control or foreseeable.

3.5 The Customer shall bear the shipping costs of the ordered goods. The delivery charge will be displayed to the Customer when placing the order.

3.6 The Customer is responsible for the accuracy of the information and contact details required for the delivery to the Seller. If the Customer has provided incorrect delivery contact details and the parcel is returned, the normal applicable delivery charge will apply when the parcel is resent.

4. Right of withdrawal

4.1 After receipt of the order, the buyer has the right to withdraw from the contract concluded in the online shop within 14 days. The right of withdrawal does not apply to legal persons.

4.2 The right of withdrawal does not apply to live goods (plants).

4.3 In order to return the goods, a written application must be submitted and sent to info@tiigitaimed.ee within 14 days of receipt of the goods.

4.4 In order to exercise the 14-day right of withdrawal, the goods ordered must not have been used in any other way than would have been necessary to ascertain the nature, characteristics and functioning of the goods in the same way as is permitted for testing the product in a physical shop. If the goods have been used for a purpose other than that necessary to ascertain the nature, characteristics and functioning of the goods, or if the goods show signs of wear and tear, the seller has the right to reduce the refund in proportion to the reduction in the value of the goods.

4.5 The Seller will not reimburse the shipping costs of the returned product, unless the reason for the return was due to the fact that the returned product did not correspond to the order, e.g.. the product was wrong or defective.

4.6 The Client must return the Goods within 14 days of the date of the application or provide written proof that he has handed over the Goods to the Carrier within the aforementioned period.

4.7 Upon receipt of the returned Goods, the E-shop shall refund to the Customer immediately, but not later than within 14 days from the receipt of the withdrawal, all payments received from the Customer for the Goods under the Contract.

4.8 The e-shop may refuse to refund until it has received the returned item or until the buyer has provided proof that it has returned the item, whichever is the earlier.

4.9 Tiigitehnika OÜ reserves the right to withdraw from the sales transaction and to demand the return of the goods from the customer, if the price of the ordered goods in the E-shop is significantly below the market price of the goods due to an error.

5. Complaints procedure

5.1 Tiigitehnika OÜ shall be liable to the Buyer for non-conformity of the goods sold to the Buyer with the terms of the contract or for defects that already existed at the time of delivery of the goods.

5.3 In the case of live goods (plants), claims can be made up to the moment when the buyer took physical possession of the goods ordered.

5.4 The E-shop will review all complaints and will respond to the customer as soon as possible, but not later than 15 days from the receipt of the complaint.

6. Processing of personal data

6.1 The e-shop uses the personal data provided by the Customer only for the purpose of processing the order and sending the ordered goods to the Customer. The online shop forwards the necessary personal data provided by the Customer to the company providing the transport service only for the purposes necessary to deliver the goods to the Customer.

6.2 Tiigitehnika OÜ reserves the right to use the contact details provided by the Customer for the purpose of sending important information.

7. Dispute resolution

7.1 All complaints made by the Buyer must be made by e-mail to info@tiigitaimed.ee or by calling +372 510 3709 . If the Seller and the Customer are unable to settle the dispute amicably, the Customer has the right to refer the dispute to the Consumer Disputes Committee.
